Allgemeine Geschäftsbedingungen

Diese Seite gibt es nur auf Französisch und Englisch. Hier steht die englische Übersetzung; maßgeblich ist die französische Fassung.
1. Who sells
These terms of sale apply to every order placed on irisup.com with Ody Labs, a French SASU with a share capital of 1 000 €, 47 rue Vivienne, 75002 Paris, RCS Paris 109 687 301, SIRET 109 687 301 00019, VAT FR85109687301 — contact: hello@irisup.com. They are for consumers. You accept them by ticking the box shown before payment; the version that applies is the one in force on the day of the order (version of 2026-10-05). The French text prevails.
2. Who can order
You must be an adult acting in a personal capacity. You may only upload a photograph of your own eye, or of someone who has agreed to it (their parents for a minor). You guarantee that you hold these rights. For a Duo you confirm this for both photographs by ticking a box before the previews are made; we keep the date of that confirmation with your order.
3. The products
Irisup makes an artwork from the iris photograph you upload: the photo is checked, the iris is isolated, then the artwork is generated by an artificial-intelligence model in the style you choose. The result is an artistic interpretation; it carries your iris's colours and pattern without being an exact reproduction. You see the artwork before ordering, and that artwork is what is printed.
Supports (poster, framed print, acrylic glass, aluminium), sizes and finishes are described on the print step. Colours on screen depend on your display and may differ slightly from the print. As an option you can buy the high-definition file of the artwork (“4K digital file”), sold only with a print, for personal use.
4. Prices
Prices are in euros, all taxes included. Delivery, priced per type of support, is shown before you order and confirmed on the payment page before you pay. The price paid is the one shown when the order is placed.
5. Ordering
You upload your photo, choose a style, verify your email, choose the support and check the summary. By ticking the box accepting these terms and clicking the payment button, you are taken to the secure payment page, where you enter your delivery address. The contract is concluded on payment. We send a confirmation email with a link to these terms, and keep a record of the order and of the version of the terms accepted.
6. Payment
Payment is taken when you order, by card or the other methods offered on the payment page, run by Shopify. We never have access to your card details.
7. Production and delivery
Each print is made to order by our partner Gelato in a print shop in the European Union close to the delivery address. We deliver in France. Indicative lead time: 3 to 5 working days on average from order to delivery. Unless a different date is given when you order, delivery happens no later than 30 days after the contract is concluded.
If delivery is late you may ask us to deliver within a reasonable additional period; failing that, you may terminate the contract and be refunded within 14 days (French Consumer Code, L216-6 and L216-3). Risk passes to you on receipt of the parcel. If a parcel arrives damaged, tell us with photos as soon as possible: we have it reprinted.
The digital file is available on your order page as soon as payment is confirmed. Download it: it is deleted 30 days after the print is delivered, along with all the order's files.
8. Right of withdrawal
The 14-day right of withdrawal does not apply:
- to prints, which are made to your specifications and clearly personalised — they are made from your photo (French Consumer Code, L221-28 3°);
- to the digital file, whose immediate supply you request by ticking, before payment, the box by which you give your express consent and acknowledge that you lose your right of withdrawal (L221-28 13°).
Should an order nonetheless carry a right of withdrawal, you could exercise it within 14 days of receipt by any unambiguous statement sent to hello@irisup.com, or with the form in the annex. We would refund you within 14 days, by the payment method you used.
This exclusion does not limit the legal guarantees below: a defective or damaged print is replaced or refunded.
9. Legal guarantees
Prints carry the legal guarantee of conformity for goods and the guarantee against hidden defects; the digital file carries the legal guarantee of conformity for digital content. To invoke it, write to hello@irisup.com. The boxes below translate the statutory model; the French text in the French terms prevails.
Prints — legal guarantee of conformity for goods
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity when a lack of conformity appears. During that period, the consumer need only establish that the lack of conformity exists, not when it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for more than two years, the legal guarantee applies to that digital content or service throughout the planned supply period. During that period, the consumer need only establish that the lack of conformity affecting the digital content or service exists, not when it appeared.
The legal guarantee of conformity obliges the professional, where relevant, to supply every update needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date the goods are replaced.
The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be refunded in full against return of the goods, if:
1° the professional refuses to repair or replace the goods;
2° repair or replacement takes place after thirty days;
3° repair or replacement causes the consumer major inconvenience, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller's unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer then need not first ask for repair or replacement.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee until the goods are delivered back in working order.
The rights above result from articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against their return.
Digital file — legal guarantee of conformity for digital content
The consumer has two years from supply of the digital content or service to invoke the legal guarantee of conformity when a lack of conformity appears. For one year from the date of supply, the consumer need only establish that the lack of conformity exists, not when it appeared.
The legal guarantee of conformity obliges the professional to supply every update needed to keep the digital content or service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or service brought into conformity without undue delay after the request, free of charge and without major inconvenience.
The consumer may obtain a price reduction while keeping the digital content or service, or end the contract and be refunded in full against giving up the digital content or service, if:
1° the professional refuses to bring the digital content or service into conformity;
2° bringing it into conformity is unjustifiably delayed;
3° it cannot be brought into conformity without costs imposed on the consumer;
4° bringing it into conformity causes the consumer major inconvenience;
5° the lack of conformity persists despite the professional's unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer then need not first ask for the digital content or service to be brought into conformity.
Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for payment of a price.
Any period during which the digital content or service is unavailable while being brought into conformity suspends the remaining guarantee until conforming digital content or service is supplied again.
The rights above result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A professional who in bad faith obstructs the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or service is kept, or to a full refund against giving it up.
10. The artwork and your photos
You authorise us to use your photo only to create, show, print and deliver your artwork. We do not use it for any other purpose, including our own communication, without your written consent. You may use the artwork and the digital file you bought for personal, non-commercial purposes, including having them reprinted. The styles, texts and interface of the site remain ours.
You may not upload an image that is not a photo of an eye or that infringes someone else's rights, or use the site by automated means. We may refuse a photo or an order that breaks these rules.
11. Personal data
See the privacy policy. Photos are deleted automatically, and at any time on request.
12. Customer service and complaints
Write to hello@irisup.com or use the chat on the site. We answer within two working days.
13. Mediation
In accordance with articles L612-1 and L616-1 of the French Consumer Code, Ody Labs has set up a consumer mediation scheme. After a written complaint to Ody Labs that has not been resolved, you may refer the dispute free of charge to the consumer mediator: CM2C (Centre de la Médiation de la Consommation des Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris — https://www.cm2c.net (opens in a new tab).
14. Governing law
These terms are governed by French law, without depriving you of the protection of the mandatory provisions of the law of your country of residence. You may bring a dispute before the courts of the place where you lived at the time of the order.
